INFORMATION ACT EX ART. 13 OF EU REGULATION N. 2016/679 ("GDPR")
With specific reference to personal data according to the art. 4 no. 1 of the GDPR (hereafter only "EU Regulation") which concern you as an "interested" subject according to the art. 4 no. 1 of the EU Regulation, the writer Fenix Safety S.R.L., (hereafter "Fenix") (VAT RO 34025590), with registered office DN28, NR. 154, 707410 Valea Lupului (IASI) ROMANIA, as Data Controller pursuant to art. 26 of the EU Regulation no. 2016/679 ("GDPR") informs you that, pursuant to art. 13 of the GDPR, your personal data described in the following art. 1 will be processed for the purposes described in the following art. 2.
According to the art. 26 paragraph II of the GDPR, the essential content of the joint ownership agreement is made available to interested parties, who can request it at the following email address: info.privacy@fenixsafety.it
1. Nature and type of data collected and processed.
1.1. The Joint Controllers will process your personal data pursuant to art. 4 n. 1 of the GDPR, including location data pursuant to art. 2 letter c) of Directive no. 2002/58 / EC (amended by Directive no. 2009/136 / EC), for the execution of the processing purposes illustrated in the following art. 3.
2. Information on the Joint Data Controllers and the Data Protection Officer group.
2.1. The Joint Data Controller is FENIX, which can be contacted at the following address: info.privacy@fenixsafety.com. The Data Protection Officer cd. of the group, nominated by FENIX, is NOVARA PAOLO.
2.2. We inform you that any changes or updates regarding the data relating to the subjects indicated above will be suitably published on the websites of each Data Controller.
3. Purpose and legal basis of the treatment.
3.1. In compliance with art. 6 paragraph 1 letter b) of the GDPR and of the art. 16 of the Charter of Fundamental Rights of the European Union, yours personal data will be processed by the Joint Controllers for the execution of the following purposes:
a. Correct and effective use of the "Fenix Safety" mobile application and connection device, including, but not limited to, geolocation and / or tracking activity following use of the App and the connected device.
4. Dissemination and communication.
4.1. In compliance with art. 13 paragraph 1 letter e) of the GDPR, the Joint Controller reports that your personal data may be disclosed to so-called subjects. third parties for the sole and sole purpose of a correct execution of the processing purposes illustrated in the previous art. 3
5. Data retention period.
5.1. In compliance with art. 13 paragraph 2 letter a) of the GDPR, the Joint Controller informs you that the retention period of your personal data processed for the purposes referred to in art. 3.1 letter a) will coincide with a term not exceeding the complete pursuit of the purposes in question, possibly extendable in order to execute a legal obligation or for the possible need to manage an out-of-court or judicial dispute promoted by or against the Joint Controller
6. Processing methods.
6.1. The processing of your personal data is carried out by the Joint Controllers through paper, computer and / or electronic methods as well as is based on compliance with the principles set out in the national and community legislation in force on the subject.
7. Principles applied to the processing of your personal data.
7.1. Your personal data will be processed in full and total compliance with the principles expressed by art. 5 of the GDPR.
8. Rights of the interested party.
8.1. In relation to your personal data, we inform you that you have the right to exercise the rights provided for by art. from 15 to 22 and from 77 to 79 of the GDPR.
8.2. In compliance with art. 12 paragraph 1 of the GDPR, the Joint Controllers undertake to provide you with the communications referred to in art. from 15 to 22 of the GDPR in a concise, transparent, intelligible, easily accessible and in simple and clear language: this information will be provided in writing or by any other electronic means or, at the request of the interested party, will be provided orally, provided the identity of the interested party is proven by other means.
8.3. In compliance with art. 12 paragraph 3 of the GDPR, the Joint Data Controllers inform you that they undertake to provide you with information relating to the action taken regarding a request pursuant to art. from 15 to 22 of the GDPR without undue delay and, in any case, at the latest within one month of receiving the request; this deadline can be extended by two months, if necessary, taking into account the complexity and the number of requests.
8.4. In order to be able to exercise the rights described in this article, you can use the contact data specified in art. 2 of this information.
